Los Angeles County judge has dropped the charges against four social workers who were in connection with the torture death of 8 year old Gabriel Fernandez, for a second time. First charges were dismissed back in 2018 when LA county DA filed charges of child abuse and falsifying records against the social workers.
According to the Los Angeles Times, the 2nd District Court of Appeal said the social workers
never had the requisite duty to control the abusers and did not have care or custody of Gabriel
Prosecutors argued that the four social workers had a legal duty to protect the 8 year old.
Gabriel died in May 2013 after suffering abuse and torture for months from his mother and her boyfriend. The boyfriend was sentenced to death and the mother is serving life in prison.
